The current legislative programme does not include provision for legislation to ensure consultation takes place when local authorities take steps to sell, lease or grant easements over publicly owned land.

Existing legislation gives some protection to the general public over specific classes of publicly owned land, for example the Allotments Act 1925 in respect of allotments and the Local Government Act 1972 in respect of public open space.

The Playing Fields (Community Involvement in Disposal Decisions) (Wales) Regulations 2015 also impose duties on local authorities in Wales to consult within their local authority area prior to disposal of a playing field or part of a playing field, subject to exceptions. These regulations were enacted under the Playing Fields (Community Involvement in Disposal Decisions) (Wales) Measure 2010.
