Regulatory impact assessments were conducted in relation to the Renting Homes (Wales) Act 2016 (‘the 2016 Act’) and the amending Act of 2021. It has long been accepted that current housing law is very complex and difficult to navigate for both landlord and tenant. The new legislative framework under the 2016 Act will make the process of renting simpler, more consistent, and more transparent. The Act will clarify the rights and responsibilities of landlords and contract-holders (tenants) by requiring written statements of contracts removing the reliance on implied terms and often obscure case law. This will avoid costly and time-consuming disputes and court actions.
